So you were recently pulled over by the police under suspicion of drunk driving.  Perhaps you were asked if you have had any drinks earlier.  You were then asked to step out of the car and the cop put you through various field sobriety tests (FST) on the side of the road.  Perhaps you did not complete those FSTs to the cop’s satisfaction.  Maybe you were driven downtown and asked to blow into a breathalyzer.  Perhaps you did or perhaps you refused.  Regardless, you are now looking at a DUI charge and possibly a revoked driver’s license.  You need legal counsel and you need legal counsel now.  We do DUI cases. 

South Carolina has a DUI statute that specifically indicates what the duties and responsibilities of an arresting officer are in relation to DUI stops.  If an officer fails to follow these rules, a case can possibly be thrown out.  By way of example, a police officer is supposed to video record an entire DUI stop from the point of blue lights until the conclusion of the arrest.  If the cop fails to do so, and it happens more than you might think that it does, the case may possibly be thrown out.  Further, if a police officer fails to follow the appropriate procedures in giving you the FSTs, the case may also be thrown out.  DUI law is very technical and revolves to a large degree on the activity of the police officer at the time of arrest.  If you have recently been charged with DUI, call the law office of Richard S. Stewart for the aggressive representation that you will need to fight the charge.
