South Carolina has a DUI statute that specifically indicates what the duties and responsibilities of an arresting officer are in relation to DUI stops. If an officer fails to follow these rules, a case can possibly be thrown out. By way of example, a police officer is supposed to video record an entire DUI stop from the point of blue lights until the conclusion of the arrest. If the cop fails to do so, and it happens more than you might think that it does, the case may possibly be thrown out. Further, if a police officer fails to follow the appropriate procedures in giving you the FSTs, the case may also be thrown out.
